1. Parties

This agreement is entered into between the host, owner of the local accommodation (Gonçalo Costa, the Host), and the guest making the booking (Guest). By confirming a booking, the Guest declares to have read, understood and accepted these Terms and Conditions.

2. Booking Confirmation

The booking is considered confirmed upon receipt of full payment and written confirmation by the Host. The Host reserves the right to decline bookings at their discretion.

3. Payment

The total amount is due at the time of booking, unless otherwise agreed in writing. For bank transfer payments, payment must be completed within 24 hours of reservation submission.

Proof of payment does not constitute booking confirmation. The booking is only confirmed when the full amount is actually credited to the Host's account. Unpaid reservations will be cancelled and dates released.

4. Cancellation Policy

Cancellation must be communicated in writing (email). The cancellation date is the date the written communication is received by the Host. No-shows, late arrivals, reductions in party size and early departures are non-refundable.

Travel insurance covering cancellations is strongly recommended.

In the event of cancellation by the Host due to force majeure, the Guest will receive a full refund. The Host shall not be liable for additional costs such as flights or alternative accommodation.

5. Check-in and Check-out

Check-in and check-out times are communicated upon booking confirmation and are strictly enforced. Check-in or check-out outside agreed times are subject to availability and may incur additional charges, to be agreed in writing in advance.

Access to the property using the provided code constitutes confirmation of receipt of the contracted service and its conformity with what was agreed, regardless of whether the Guest actually makes use of the accommodation.

6. Number of Guests and House Rules

The maximum number of guests is as stated in the property listing. Undeclared additional guests may result in extra charges or immediate termination of the stay without refund.

Failure to comply with house rules may result in immediate termination of the stay without refund and forfeiture of the security deposit.

7. Security Deposit

The security deposit will be pre-authorised on the Guest's card 3 to 5 days before check-in and automatically released within 4 working days after check-out, provided there are no damages, excessive dirt or other outstanding charges. The Host reserves the right to charge the Guest for repair or replacement costs for any damages caused during the stay.

8. Liability

The Guest is responsible for any damage caused to the property or its contents during the stay. The Host accepts no responsibility for theft, loss or accidents on the premises, nor for guests' personal belongings.

The Host is not responsible for failures in external services such as electricity, water, internet or television, nor for construction or noise in the surrounding area. Every effort will be made to resolve any issues within a reasonable timeframe after notification.

9. Property Access

Host-designated staff may access the property to carry out necessary repairs or cleaning, with prior notice whenever possible. The Guest agrees to lock all doors and windows whenever absent from the property.

10. Payment Dispute Waiver

By confirming the booking, the Guest expressly accepts the cancellation policy defined in clause 4 and agrees not to resort to chargeback or payment dispute mechanisms with banking or payment institutions as a substitute for the cancellation procedure. The improper use of chargebacks in situations covered by this policy may be contested by the Host using booking documentation, exchanged communications and property access records.

11. Data Protection

Personal data collected is processed in accordance with the General Data Protection Regulation (GDPR) and applicable Portuguese legislation, and is used exclusively for booking management and compliance with legal obligations, namely the registration of guests with AIMA. Data will not be shared with third parties without the Guest's express consent.

12. Governing Law

This agreement is governed by Portuguese law. In the event of a dispute, the parties may refer the matter to the competent Consumer Conflict Arbitration Centre, in accordance with Portuguese legislation.

13. Acceptance

Booking confirmation and payment constitute express and unequivocal acceptance of these Terms and Conditions. The Guest declares to have read and understood all clauses, including the Cancellation Policy set out in clause 4.
 

14. Service Deemed Rendered

The service is considered rendered from the moment the Guest receives the property access details (entry code or equivalent), regardless of whether the Guest actually makes use of the accommodation.
